Terms of Service

These Terms of Service ("Terms") govern your access to and use of the UpFrench platform. By registering as an organisation or completing an assessment as a student, you agree to be bound by these Terms. Please read them carefully.
1. Definitions
- "Platform" refers to the UpFrench website and associated services available at upfrench.com.
- "Organisation" refers to any entity that registers an administrator account to use UpFrench for assessment purposes.
- "Administrator" refers to individuals with access to an organisation's UpFrench dashboard.
- "Student" refers to any individual who completes or attempts a placement assessment via the Platform.
- "We", "us", "our" refers to UpFrench.
2. Use of the Platform
UpFrench grants organisations a limited, non-exclusive, non-transferable licence to use the Platform for the purposes of administering French language placement assessments to their students.
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorised access to any part of the Platform or its systems
- Share login credentials with unauthorised individuals
- Misrepresent your identity or affiliation when registering
- Use automated tools to scrape, crawl, or extract data from the Platform
- Reproduce, distribute, or resell any part of the Platform without written permission
3. Organisation Responsibilities
Organisations are responsible for:
- Ensuring students are informed that their assessment data will be stored and processed by UpFrench in accordance with our Privacy Policy
- Obtaining any necessary consents from students prior to directing them to the Platform
- Maintaining the confidentiality of administrator login credentials
- Ensuring that assessment results are communicated and used fairly and appropriately
- Promptly notifying us of any suspected unauthorised access to their account
4. Student Use
Students access the Platform at the direction of a registered organisation. By completing an assessment, students acknowledge that their responses will be reviewed by the administering organisation and that results will be communicated to them by email.
Students must complete assessments honestly and without the use of unauthorised assistance. The Platform monitors tab-switching activity as a basic measure of academic integrity.
5. Intellectual Property
All content on the Platform, including but not limited to assessment questions, design, code, and trademarks, is the intellectual property of UpFrench or its licensors. Nothing in these Terms grants you ownership of any intellectual property.
Organisation administrators retain ownership of any custom email templates or content they create within the Platform.
6. Availability & Modifications
We endeavour to maintain the Platform's availability at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with reasonable notice where practicable.
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
7. Disclaimers & Limitation of Liability
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, UpFrench disclaims all warranties, including fitness for a particular purpose and non-infringement.
UpFrench shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of data, revenue, or business opportunity.
Our total liability to any party, whether in contract, tort, or otherwise, shall not exceed the amount paid by that party to UpFrench in the twelve months preceding the claim.
8. Termination
We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to the security of the Platform or other users.
Organisations may request closure of their account by contacting us via the contact page. Upon closure, associated data will be deleted in accordance with our Privacy Policy.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of the relevant jurisdiction.
